MCCM Obtains Settlement Requiring Carrier to Pay Nearly Double the Amount of Available Insurance Coverage

After refusing to accept a series of nominal offers from the defendant’s insurance carrier, our law firm obtained a jury verdict well in excess of the defendant’s policy limits in favor of our 31-year old client, who suffered a fractured collarbone and “winging” scapula in a motorcycle vs. motor vehicle accident. Following trial, the insurance carrier agreed to pay the plaintiff nearly twice the defendant’s policy limits in order to avoid a “bad faith” claim.
Mr. Barden is a partner in the firm’s litigation department where he represents clients seriously injured due to the negligence or misconduct of others. Mr. Barden also represents physicians and other licensed health care professionals in disciplinary matters before the Office of Professional Discipline and the Office of Professional Medical Conduct. His passion for medical-legal cases arose during his service with the Army Claims Service. Paul was responsible for supervising and adjudicating hundreds of medical malpractice and other injury claims filed against the Army through eight different claims offices covering four states in the southwestern United States. He received extensive training in the investigation and analysis of tort claims as well as the evaluation of injuries. The culmination of this training was attendance at a month long training course in a military health facility where he observed a variety of medical procedures and received classroom instruction by physicians from nearly every major medical specialty.
